Arkansas Adoption Rights For Birth Parents

In Arkansas, you have 10 calendar days after signing your consent to adopt (or 5 days if you elect to waive the full period) to change your mind for any reason.

During this period, you can file an affidavit with the probate division clerk of the designated circuit court to revoke your consent. If the period ends on a weekend or legal holiday, you may file on the next working day.

If you revoke your consent before a decree of adoption is entered, the adoption process is halted, and custody will revert, pending any necessary court orders for the child’s safety.

⚠️ CAUTION: WAIVER OF REVOCATION RIGHTS ⚠️

Arkansas law allows you to elect to waive your standard 10‑day revocation period, reducing your withdrawal window to 5 calendar days after signing your consent or after the child is born (whichever is later).

This waiver must be clearly stated on the consent form. By electing the waiver, you agree to a significantly reduced time frame during which you can file an affidavit to revoke your consent.

Be aware: some agencies or adoptive parents may pressure you to sign this waiver immediately, but you are never required to waive your revocation rights.
